Terms & Conditions

EFFECTIVE JANUARY 1, 2025

As a hybrid publisher, we offer publishing services for authors, including expert editorial support, design, marketing, and distribution, to help bring their books to life. Our goal is to collaborate with authors to create a polished and professionally produced book that meets industry standards. While we provide comprehensive support in these areas, it is important to note that we do not necessarily align with or endorse the views, themes, or messages presented in the works we offer publishing services for. Our focus is on delivering a polished, well-crafted product that allows authors to express their unique voices and ideas.

  1. Author Responsibility and Indemnification: The author acknowledges that Mission Point Press serves solely as a publishing service provider. The author retains full responsibility for the content of their work, including but not limited to its accuracy, legality, and appropriateness. This includes the obligation to ensure that the work does not infringe upon any copyrights or intellectual property rights of third parties. The author is responsible for obtaining any necessary permissions for the use of copyrighted material, including, but not limited to, photography, artwork, song lyrics, poetry, quotations, and other creative works. Mission Point Press disclaims any liability for any claims, damages, or legal issues that may arise from the publication.

  2. Intellectual Property Rights: The author retains full ownership of the copyright, intellectual property rights, and all royalties from the book. Mission Point Press only holds the necessary rights to complete the publishing services and does not claim ownership. The author is responsible for ensuring the content is free from copyright infringement, defamation, or legal issues and agrees to hold Mission Point Press harmless from any legal actions, including those arising from media or negative publicity related to the book.

  3. Project Scope: This agreement is based on the information provided at the start of the project. If any aspects of the project change during production, the author acknowledges that Mission Point Press may need to make adjustments to the scope, which could impact production dates and costs.

  4. Confidentiality: Mission Point Press agrees to keep the author’s manuscript and any confidential materials shared during the project confidential and will not share such materials with any third parties without written consent from the author.

  5. Production Schedule: Once a production schedule with assigned dates has been agreed upon, Mission Point Press will adhere strictly to these dates. In the event of delays or setbacks due to unforeseen challenges or project-specific issues, the publishing schedule will be adjusted accordingly in consultation with the author or the author's representatives.

  6. Timeliness and Rush Charges: The author agrees to adhere to the timelines throughout the project. Any delays that jeopardize the final publication date may result in the author incurring rush charges or penalties.

  7. Project Interruption: If a project is halted due to extenuating circumstances, Mission Point Press reserves the right to remove the project from the publication schedule and invoice the author for all work completed up to that point. Additionally, a 25% kill fee will be charged based on the total cost of the original production proposal. If the project remains inactive for more than four weeks, a new publication schedule will be established upon resumption. If the author anticipates a delay or needs to adjust the timeline, they must provide written notice to Mission Point Press as soon as possible. Mission Point Press will collaborate with the author to revise the schedule; however, any delays may incur additional costs or affect the final publication date. Mission Point Press reserves the right to make adjustments to the project scope and timeline based on these changes.

  8. Overall Content Approval: Mission Point Press reserves the right to not publish the author’s book if any part of the final version does not meet the publisher’s editorial and design standards. In such cases, Mission Point Press will collaborate with the author to address these issues, but the final decision to publish will remain at the publisher's discretion.

  9. Distribution: Mission Point Press will make every effort to distribute the book through IngramSpark and/or Kindle Direct Publishing (KDP). Once the book is sent to these POD vendors, the author is solely responsible for managing their IngramSpark and KDP accounts. Mission Point Press encourages authors to review recommended online resources to help manage these accounts but cannot guarantee approval from POD vendors. If a book is rejected or delayed, Mission Point Press will assist in identifying the cause and provide support, but final approval rests with the POD vendors. Additionally, Mission Point Press will not upload the final book files to KDP, IngramSpark, or any other platform until all invoices are paid, the author has reviewed and signed off on the final files, and written consent to proceed is provided. Delays in meeting these requirements may impact the book's release schedule.

  10. Sensitivity: The author acknowledges and agrees that Mission Point Press, its staff, and its representatives bear no responsibility for any sensitive issues or content related to race, ethnicity, religion, gender, sexual permissiveness, or any other potentially libelous or controversial matters contained within the manuscript. This includes, but is not limited to, explicit sexual content. The author is solely responsible for the content of their work, including but not limited to any claims or statements that may be deemed sensitive, controversial, or legally questionable. The author agrees to indemnify and hold harmless Mission Point Press, its staff, and its representatives from any and all claims, liabilities, damages, or expenses arising from such content.

  11. Cancellation and Kill Fee: Either Mission Point Press or the author may cancel the project at any time if it deviates from the agreed scope, is no longer in the best interest of either party, or for any valid reason. If the author cancels the project, Mission Point Press may prorate the services rendered up to that point at its discretion. If the cancellation occurs within the first month after signing into production, the author will be responsible for prorated charges for the production services, and a $500 kill fee will be added to cover initial administrative costs. In all cases, the author will receive all completed project materials.

  12. Costs and Late Payments: Any costs outlined are valid for 7 days. Late payments will incur interest at a rate of 10% per annum, calculated monthly, unless otherwise restricted by law. Additionally, a flat late fee of $200 will be applied for each 30-day period the payment remains overdue, to cover administrative and operational costs. If payment is not received within 30 days of the due date, Mission Point Press reserves the right to suspend all services, including not loading or publishing the book, until the account is brought current. Should payment remain outstanding for 60 days, Mission Point Press may terminate the agreement and pursue necessary mediation or legal action to recover the balance, with the author responsible for all costs associated with the collection process, including legal fees and court costs

  13. Marketing Results: Marketing and public relations efforts take time to show results, and outcomes can vary due to factors beyond our control. While Mission Point Press is dedicated to running strategic and effective campaigns, it cannot guarantee specific sales figures, media placements, or other measurable results. Additional marketing proposals will outline their own set of terms and conditions.

  14. Illustration: If the author chooses to provide their own illustrator/illustrations, the author is responsible for ensuring that the artwork meets the publisher’s professional and technical standards. If the illustrations require revisions, they must be completed within the established project deadlines to maintain the publication schedule. Additionally, coordination with the illustrator is the sole responsibility of the author. If additional coordination between the author and illustrator is needed, it will be billed at an hourly rate. 

  15. Harassment: Mission Point Press reserves the right to terminate its business relationship with the author or their agents at any time if any form of harassment, abusive language, or inappropriate behavior toward our staff occurs. This includes, but is not limited to, persistent disrespect, threats, or any written or verbal communication that is hostile, offensive, or otherwise deemed unacceptable. In such cases, Mission Point Press will notify the author in writing of the termination and will provide all completed deliverables up to that point. A cancellation fee will be applied in accordance with our policy. Mission Point Press maintains a zero-tolerance policy for harassment to ensure a professional, respectful, and productive working environment. In return, Mission Point Press is committed to maintaining a high level of professionalism throughout the project.

  16. Dispute Resolution: In the event of a dispute, both parties agree to resolve the issue through mediation or arbitration before taking legal action. Any legal proceedings will take place in the jurisdiction where Mission Point Press is located.
